In June of 2016, a woman called Miss Kelly was interviewed by an psychiatric nurse in the community that she wanted to end her life. She refused to be detained by the Mental Health Act but agreed to an assessment of treatment at home. However, the assessor feared that she was a risk to herself or others, and was not convinced that she was competent enough to give consent.

The assessor then recommended that Miss Kelly should be held against her wishes. Miss Kelly did not want to be in a unit so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a consultant psychiatrist at the Home Treatment Team of Essex Partnership NHS Foundation Trust.

In response to this suggestion, the Home Treatment Team conducted a comprehensive assessment of Miss Kelly’s state of mind and her current functioning. The review included an in-depth medical history and physical examination. It also involved a detailed assessment of family and psychological therapy and a psychiatric diagnostic interview.

According to the report, Miss Kelly suffered from a number of mental health issues, including the borderline personality disorder such as bulimia, anorexia and bulimia. She had also been assaulted by her husband and was a drug addict. Her symptoms were exacerbated by stress, anxiety, and depression. She was also diagnosed with bipolar affective disorder as well as schizoaffective disorder.

Medtronic has not provided evidence that its decisions were based upon these elements. Furthermore, Elayaperumal’s less-than-perfect performance review did not result in an increase in his salary, benefits, or the responsibilities he had.
